1. Introduction
These Terms and Conditions govern your use of the South Peninsula Moms website at southpeninsulamoms.co.za and any services offered through it. By using our website or purchasing a listing subscription, you agree to be bound by these terms.
Please read these terms carefully before using our site or purchasing a subscription.

3. Definitions
- “We”, “us”, “our” refers to South Peninsula Moms.
- “You”, “your” refers to the person or business using our website or purchasing a subscription.
- “Listing” refers to a business profile page published on our website.
- “Subscription” refers to a paid listing plan (Basic, Premium, or Managed) purchased through our website.
- “Content” refers to any text, images, logos, or other material submitted by you for inclusion in your listing.
4. Listing Subscriptions
We offer the following listing subscription tiers:
Basic Listing — R250 per year (recurring annual subscription)
Premium Listing — from R200 per month (recurring monthly subscription). Multiple Premium options are available with different posting frequencies. Full details are listed on the Premium Listing Options page.
Managed Listing — R600 per month (recurring monthly subscription). You provide us with your content (text, images, and other materials) and we manage all posting on your behalf.
Charity Listing — Free, subject to approval by South Peninsula Moms. Only registered non-profit organisations or verified community charities are eligible.
Subscription pricing is subject to change. We will notify existing subscribers of any price changes at least 30 days in advance.
5. Payment and Billing
Payments are processed securely through PayFast, a South African payment gateway. By purchasing a subscription, you authorise recurring payments to be charged to your chosen payment method at the applicable billing interval (monthly or annually).
Subscriptions renew automatically unless cancelled before the renewal date. It is your responsibility to cancel your subscription if you no longer wish to continue.
We do not store your payment card details on our servers. All payment data is handled by PayFast in accordance with their terms and privacy policy.
6. Cancellations and Refunds
You may cancel your subscription at any time through your account on our website. Cancellation will take effect at the end of your current billing period. You will not be billed again after cancellation, but no refunds will be issued for the remaining portion of the current billing period.
If you believe you have been charged in error, please contact us at nicole@southpeninsulamoms.co.za within 7 days of the charge and we will investigate.
In line with the Consumer Protection Act (CPA), if you cancel within 5 business days of your first subscription purchase, you are entitled to a full refund.
7. Your Listing Content
You are responsible for all content you submit for your business listing. By submitting content, you confirm that:
- You own or have the right to use all submitted text, images, and other materials.
- The content is accurate and not misleading.
- The content does not infringe any third-party intellectual property rights.
- The content complies with all applicable South African laws.
We reserve the right to edit, reject, or remove any listing or content that we consider inappropriate, inaccurate, or in breach of these terms, without notice or refund.
8. Managed Listing Service
For Managed Listing subscribers, you agree to provide us with the content required for your listing and social media posts (including text, images, and relevant information) in a timely manner. We will post on your behalf according to the agreed schedule.
We will take reasonable care in preparing and publishing your content, but we are not liable for any errors, omissions, or delays caused by late or incomplete content submissions from you.
9. Facebook Group
Eligible listing subscribers may have their business promoted in the South Peninsula Moms Facebook group, subject to the group’s rules and our posting schedule. Facebook group posting is offered as a benefit of certain subscription tiers but is not guaranteed and may be affected by Facebook’s policies, platform changes, or group moderation decisions beyond our control.
Posting frequency per tier is as described on our website at the time of purchase. We reserve the right to adjust posting schedules with reasonable notice.
10. Prohibited Content
You may not submit or publish content that:
- Is false, misleading, or deceptive
- Infringes any copyright, trademark, or other intellectual property
- Is defamatory, offensive, or harmful
- Promotes illegal activities
- Violates any applicable South African law
11. Intellectual Property
All content on this website that is not submitted by users (including our logo, design, text, and images) is owned by South Peninsula Moms and may not be reproduced without our written permission.
Your submitted listing content remains your property. By submitting it, you grant us a non-exclusive licence to display it on our website and, where applicable, on our social media pages as part of your subscription benefits.
12. Limitation of Liability
To the extent permitted by law, South Peninsula Moms shall not be liable for any indirect, incidental, or consequential loss arising from your use of our website or services, including but not limited to loss of business, loss of revenue, or loss of data.
Our total liability to you for any claim arising out of these terms shall not exceed the total amount paid by you for your subscription in the 3 months preceding the claim.
13. Availability of Service
We aim to keep our website available at all times, but we do not guarantee uninterrupted access. We may need to take the site offline for maintenance, updates, or due to circumstances beyond our control. We will not be liable for any loss resulting from temporary unavailability.
14. Changes to These Terms
We may update these Terms and Conditions from time to time. We will notify you of significant changes by posting the updated terms on this page with a revised date. Your continued use of our website or subscription after changes are posted constitutes your acceptance of the updated terms.
15. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the jurisdiction of the South African courts.
